TL;DR: Use Fartscroll responsibly, don't be a jerk, and have fun embarrassing yourself (and your friends, with their consent).
1. Acceptance of Terms
By installing, accessing, or using Fartscroll (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
The Service is operated by DigiSnax LLC ("we," "us," or "our").
2. Description of Service
Fartscroll is a browser extension and web application designed to help users reduce excessive video scrolling through humorous audio alerts and optional reaction video recording. The Service includes:
- Video scroll monitoring on supported platforms
- Audio playback of fart sounds at configurable thresholds
- Optional webcam reaction video recording
- Video composition and sharing tools
- Premium features for paid users
3. User Eligibility
You must be at least 13 years old to use Fartscroll. By using the Service, you represent that you meet this age requirement. Users under 18 should have parental consent.
4. Account and License
4.1 Free Users
Free users may access basic features with limitations, including watermarked videos and limited sound options.
4.2 Premium Users (Friends & Family Plan)
Premium users receive a license for themselves plus five (5) transferable friend invites. License terms:
- Licenses are perpetual (one-time purchase, no recurring fees)
- Friend invites may only be used once and cannot be resold
- License keys are non-transferable after activation
- We reserve the right to revoke licenses for Terms violations
5. Acceptable Use
You agree NOT to:
- Use Fartscroll to harass, bully, or embarrass others without their consent
- Record or share videos of minors without parental consent
- Distribute videos containing illegal, harmful, or offensive content
- Attempt to reverse engineer, modify, or distribute the Service
- Use automated systems to abuse the Service
- Resell or redistribute license keys
- Misrepresent your affiliation with Fartscroll or DigiSnax LLC
Important: Recording and sharing videos of others requires their consent. You are solely responsible for ensuring you have appropriate permissions before sharing any content featuring other people.
6. User-Generated Content
Videos created using Fartscroll are your content. You retain all rights to your videos. By using sharing features, you grant us a limited license to display the Fartscroll branding/watermark on shared content.
You are solely responsible for:
- The content of videos you create and share
- Obtaining consent from anyone appearing in your videos
- Compliance with platform terms where you share content
- Any consequences resulting from shared content
7. Intellectual Property
The Fartscroll name, logo, branding, sound effects, and software are owned by DigiSnax LLC and protected by intellectual property laws. You may not:
- Use our trademarks without written permission
- Copy or redistribute our sound effects outside the Service
- Create derivative works based on our software
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT FARTSCROLL WILL CURE YOUR DOOMSCROLLING HABIT, IMPROVE YOUR PRODUCTIVITY, OR RESULT IN VIRAL FAME.
We are not responsible for:
- Embarrassment resulting from fart sounds playing at inappropriate times
- Social consequences of sharing reaction videos
- Technical issues on third-party platforms
- Content moderation decisions by social media platforms
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGISNAX LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR REPUTATION, ARISING FROM YOUR USE OF THE SERVICE.
Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless DigiSnax LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Modifications to Service
We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may also update these Terms periodically. Continued use after changes constitutes acceptance.
13. Termination
We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe:
- Violates these Terms
- Is harmful to other users
- Is fraudulent or illegal
14. Governing Law
These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
15. Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.
